Example:
Assignor further authorizes PEP to edit the Manuscript as required to conform to PEP's standard style, or as required to make the Manuscript compatible with publication of the Manuscript in text, image, other electronic format, or such other formats or on such other medias as may now exist or hereafter be discovered, however, the Assignor reserves a right to change the spacing in the Manuscript in order to improve the legibility of mathematical expressions and equations.

Es handelt sich hierbei um einen Punkt aus der Copyright-Einverständniserklärung das ein bestimmtes mathematisches Journal (PEP) vom Autor verlangt wenn er seine Arbeit bei diesem einreicht. Die fragliche Autorisierung soll PEP eine Bevollmächtigung erteilen das Manuskript redaktionell zu bearbeiten (z.B. Formatierung von Überschriften, Orthografie, Zitierweise in Fußnoten, Spationierung, etc.). Mit dem "reserves a right to" sollte ausgedrückt werden, dass der Autor neben PEP ebenfalls ein Recht haben soll die Spationierung zu ändern, d.h., auf Änderung der Spationierung sollen beide Recht haben und auf sonstige Änderungen des Manuskripts nur PEP. Wird das im oben zitierten Punkt richtig ausgedrückt?

*media* is already plural; 'medias' does not exist

...discovered. However, the... - A full stop is necessary here.

...Assignor reserves *the* right to... - this is a well-known phrase

(OT: are media _discovered_?? I would have thought created... :))

Alternativvorschlag, den ich aus meinen Verträgen kenne: "in all media now known or hereafter devised"

I reformulated the second part of the sentence as follows (also in consideration of the other thread I started):
However, the Assignor reserves the right to change the appearance of mathematical expressions and equations in the Work in order to improve their legibility.

Is it sure that according to this expression _both_ PEP and the Assignor will have the right to change the appearance of equations, and not only the Assignor? PEP should be allowed to change everything in the Manuscript whereas the Assignor should be allowed to change only equations.

Hm, dann würde ich nicht "reserve" nehmen, weil das nach meiner Erfahrung eher sowas ausdrückt wie "das Recht übertrage ich nicht, sondern behalte es".

Vielleicht eher so: "provided, however, that Assignor shall also be entitled to change ..."

Habe jetzt in der fraglichen "copyright agreement form" zwei Punkte gefunden wo das mit "to retain a right" ausgedrückt zu werden scheint:
- Assignor retains a right to republish or grant to third parties permission to republish all or part of the Work, only if written permission is obtained from PEP.
- Assignor retains a right to reproduce the Work for his own use as well as to use all or part of the Work in his future works.

Würde demnach folgendes gehen?:
Assignor further authorizes PEP to edit the Work as required to conform to PEP's standard style,... . However, the Assignor retains a right to change the appearance of...

Sollte man die zwei Sätze (bei Verwendung von "retains a right") getrennt lassen oder doch zusammenziehen mit der Formulierung "... , provided, however, that Assignor retains..." oder "... , however, the Assignor retains..."?

Hi, Daniel, mit "retain" hab ich grundsätzlich das gleiche Problem, nämlich daß nicht ausreichend deutlich wird, daß PEP und Assignor gleichermaßen das Recht haben sollen (so lese ich es auch aus Deinen anderen beiden Beispielen).

Wäre es nicht deutlicher, wenn Du schriebest "Notwithstanding anything to the contrary in the preceding sentence, each of PEP and Assignor shall be entitled to change the appearance ..."?

Nur ein Vorschlag.

Jetzt wo ich genauer darüber nachdenke, bringt diese Formulierung die auf komplette Gleichberechtigung von PEP und Assignor hinausgeht, doch ein paar Schwierigkeiten mit sich. Der Assignor ist gegenüber dem Publikationsorgan PEP der "Schwächere" und er sollte z.B. vor dem bestimmten Fall geschützt werden, dass PEP ihm zwar die Gelegenheit gibt Änderungen vorzunehmen, jedoch PEP im Nachhinein und ohne sein Wissen Änderungen des Manuscripts vor der Publikation vornimmt, oder, dass PEP, als "träges" Organ Änderungswünsche des Assignors einfach ignoriert bzw. "durch gleichartige Rückänderungen wieder nichtig macht". Dem Assignor sollte also ein stärkeres Recht eingeräumt werden als PEP. Ich habe da an folgendes gedacht:

... each of PEP and Assignor, however PEP only in agreement with the Assignor, shall be entitled to change...

Grundsätzlich OK, aber schreib doch eher "each of PEP and Assignor, however PEP only after prior (written) approval by Assignor, shall be ..." - dann ist es GANZ deutlich. Und entpricht auch dem, was ich so an englischem "Legalese" kenne (und das auch ganz gut, wenn ich ein wenig angeben darf).

Ein "written approval" wäre wiederum zu viel (könnte den regulären Terminplan von PEP behindern und der Assignor hätte einen Aufwand das in den meisten Fällen unnötig sein sollte). Der Assignor sollte dann eher nur die Möglichkeit haben Berufung gegen Änerungen von PEP einzulegen, und das möglichst einfach und unkompliziert. Vielleicht so?:

... each of PEP and Assignor shall be entitled to change the appearance of mathematical expressions and equations in the Work, however Assignor may appeal against such changes made by PEP. Therefore PEP covenants with the Assignor that, before the Work is published, PEP provides the Assignor with an exact copy of the Work as it is going to be published, so that the final typographic design of the Work is apparent to the Assignor before the publication of the Work.

Sorry für diese "case-by-case strategy".

Deswegen hatte ich das "written" auch in Klammern gesetzt. Ansonsten, wenn das der Plan ist,klingt die englische Fassung für mich ganz OK. Go for it.

Ich versuche noch eine zeitliche Begrenzung für dieses Widerrufsrecht einzufügen:
..., however Assignor may appeal against such changes made by PEP within 48 hours after the Assignor received all information about the visual results of such changes.

Mit diesem "all information about the visual results of such changes" sollte eben gemeint sein, dass PEP dem Assignor die exakten Abbildungen der geänderten "equations" zukommen lässt (was dann im darauf folgenden Satz noch näher festgelegt wird). Dies würde per E-mail erfolgen.
